Since
the multimillion dollar verdict in favor of a previously unknown
model in the Christoff v. Nestle case, there has been an
explosion of cases filed by actors, celebrities and models under
California Civil Code sec. 3344, seeking a share of the profits
(and attorney’s fees) generated by the unauthorized use of the
party’s name or likeness. The Court of Appeals has issued its
written opinion in the Nestle case and some of the issues are
now before the California Supreme Court.
How plaintiffs prove these cases so as to maximize their damage
award, and, how manufacturers, advertisers, producers and
studios defend against these claims will be discussed by the
panel. Other recent litigation and legislative developments in
rights of publicity cases will be addressed, as well as how the
single publication rule affects discovery issues.

The “Friends” Sexual Harassment Case and What it Means for the

v. Warner Brothers Television the plaintiff was a writer’s
assistant on the popular TV sitcom “Friends.” She sued, claiming
that the frequent sex-related jokes and personal anecdotes

individual writers defended the case on the grounds that the
sexual joking was job-related given the subject matter of the
show and was protected by the First Amendment.
