In a trademark infringement case, who has the burden of proving or disproving likelihood of confusion? On December 8, 2004, in KP Permanent Make-Up, Inc. v. Lasting Impression I Inc., a unanimous Supreme Court ruled that a trademark infringement defendant raising the fair use affirmative defense does not have the burden to prove the absence of likely confusion between the competing marks. In so ruling, the Supreme Court vacated and remanded a Ninth Circuit decision that seemed to impose such a burden on a defendant claiming fair use. This was a closely watched case, and will continue to be monitored as it heads back to the Ninth Circuit.
