IP Protections in the Lifecycle of Fictional Characters
This program focuses on the copyright, trademark and other intellectual property protections applicable to fictional characters, throughout both their fictional and statutory "lives", and beyond. The panel will focus on the significant events in the life of characters, starting when a fictional character is "born", examining the impact that changes in the characters (after their inception through the end of their literary lives) may have in altering (or prolonging) the IP protections available. There will also be discussions on what it means when copyright protection concludes and the options available to extend the "lives" of these properties. The speakers on the panel are David Branfman, Esq. of Branfman Law Group, P.C. in Oceanside, CA; Jonathan Kirsch, who served as a lead intellectual property counsel for the plaintiff in Klinger v. Arthur Conan Doyle Estate, Limited, is a publishing attorney and an Adjunct Professor on the faculty of the NYU Publishing Institute; Leslie S. Klinger, a Los Angeles-based tax and estate-planning attorney, was the plaintiff in Klinger v. Conan Doyle Estate, Limited (N. D. Ill., 2013), aff'd, (7th Cir. 2014), cert. den., U. S. Supreme Court (2014); and Jay Kogan, Vice President of Legal Affairs at DC Entertainment.
