Pre-Death Contests- An Oxymoron No More
Traditionally, issues of lack of competency, undue influence, and fraud in the creation of testamentary documents (e.g. wills, trusts, POD transfers, etc.) waited until the death of the testator/settlor. No more!! Challenges to plans intended to take effect only upon death are now being prosecuted while the testator/settlor is still alive. This program will explore how the challenge is presented and how can it be fought. Issues of conflicts, representation, standing, and pleading will be discussed. Yogi Berra once said, "It ain't over, 'til it's over." Now we can say " It can certainly begin before it's over!"
