Royalty Accounting Demystified:Profit Participation & Contingent Compensation in Hollywood
Whether motion pictures, such as "Spinal Tap," or television programs such as "Home Improvement" or "The Walking Dead," the news is full of stories about disagreements between artists and studios regarding contingent compensation, also known as profit participation. This panel will discuss the nuts and bolts of royalty accounting for profit participation arrangements. First, we'll cover the basics about different types of "backend" definitions and important terms to know, and discuss "the waterfall" for how contingent compensation is calculated for profit participants. Then, we'll discuss the steps involved in performing a royalty audit. Finally, using examples from seminal cases and profit participation disputes currently in the news, the panel will talk about what happens when litigation ensues.
