Drafting Rock Solid Declarations: Presenting Evidence for Motions and Trials
Many courts require that direct testimony be submitted by declaration. An experienced bankruptcy judge and attorney will discuss:
  • Effective formats and the key Federal Rules of Evidence.
  • Selecting the best declarant.
  • Avoiding common errors.
  • Hearsay exceptions.
  • Objections: When to hold them.
  • Defending evidentiary objections.
  • Authenticating documents.
  • Avoid boring declarations: Telling the story chronologically may not be best.
  • Preparing the declarant for cross examination.
  • Signing and filing declarations
  • The most common errors with declarations.
